MEMORANDUM OF AGREEMENT between His Excellency the Governor of Hong Kong acting for and on behalf of the Colonial Government and His Excellency the General Officer Commanding the Troops in Hongkong acting for and on behalf of the War Department WHEREBY IT IS AGREED

The area of land situate in the New Territories in the

Colony of Hongkong containing three thousand five hundred

(3,500) acres and particularly delineated on the plan

marked "A" annexed hereto and thereon edged with pink and

known as Ngau Tau Kok or Kowloon Peak Military Reserve is

hereby released and handed over by the said General Officer

Commanding to the Colonial Government of Hongkong free and

discharged from any rights which the War Department may

have had in such land as a Military Reserve but not includ- ing rights of perpetual user (if any) which the War Depart-

ment may have in such land or any part thereof.

Any rent now payable by the War Department to the Colonial

Government of Hongkong in respect of such Military Reserve

In consideration of such release the Colonial Government

under take:-

(a). That no Crown land lying above the 500 foot contour

green within the area edged round with pink on the plan

marked "B" annexed hereto will be alienated by the

Government of Hongkong without previous reference to

the Military Authorities in Hongkong.

(b). That the facilities hitherto granted to the Military

Authorities in Hongkong for field practices in the

New Territories and New Kowloon will not be with-

drawn as far as the natural development of the

Colony permits but no portion of any existing catch-

ment area or of any area which may be hereafter

utilised for waterworks purposes are to be used as

camping grounds or in any similar manner.
